Assumption of Risk, Release and Indemnity Agreement (version 2026-10-v3)
I am signing this agreement for myself and for each person listed below (for any minor, as parent or legal guardian). In exchange for the chance to take part in a guided hunt with Iron Feather Outfitters ("the Outfitter"), I agree as follows.
1. I understand the risks. Hunting and being outdoors involve real risks, including firearms and ammunition, discharge of firearms by others, cold, wet and changing weather, hypothermia, slips and falls, uneven ground, mud, water, boats, vehicles, dogs, wildlife, insects, and remote locations where medical help may be far away. Serious injury or death can occur even when everyone uses reasonable care.
2. I accept those risks. I choose to take part and I accept these risks for myself and for each participant I list.
3. Release. To the fullest extent the law allows, I release and hold harmless the Outfitter, its owners, guides, employees, and the landowners and land managers who allow access, from claims for injury, death, or property loss arising from the hunt, including claims based on ordinary negligence. This does not release claims for gross negligence or intentional misconduct.
4. Safety rules. I will follow the guide's instructions and all hunting laws. I will keep firearms unloaded and pointed in a safe direction until the guide says otherwise, keep my finger off the trigger until I am ready to shoot, be sure of my target and what is beyond it, use non-toxic shot only, and not shoot outside legal shooting hours. The guide may end the hunt for anyone who acts unsafely, with no refund.
5. Licenses and requirements. I am responsible for having a valid hunting license, any required stamps and tags, and proof of hunter education where the law requires it, for myself and each participant.
6. Alcohol and drugs. No participant will hunt while impaired by alcohol or drugs.
7. Health. Each participant is physically able to take part and I will tell the guide about any condition that may affect safety.
8. Photos. The Outfitter may take photos and video during the hunt and use them for marketing unless I tell the guide I do not agree.
9. Minors. A parent or legal guardian must sign for each participant under 18, and an adult must stay with that minor as the guide directs.
10. Firearms and game laws. I represent that I am not prohibited by state or federal law from possessing a firearm, that I hold the licenses and stamps required to hunt waterfowl in Idaho, and that I will follow all game laws (including bag limits, tagging, and shooting hours) and the directions of my guide.
11. Indemnity. To the fullest extent the law allows, I will indemnify and defend the Outfitter, its owners, guides, employees, and the landowners and land managers who allow access, against claims, damages, fines, and reasonable legal costs brought by anyone else (including another hunter) that arise from my actions or those of a participant I list, such as unsafe firearm handling, violating hunting laws, hunting while impaired, or a dog I bring. This does not apply to claims caused by the Outfitter's gross negligence or intentional misconduct.
12. Other terms. If any part of this agreement is found unenforceable, the rest still applies. Idaho law governs. I have read this agreement, I understand it, and I sign it freely.
